Kuiz Teka Teki SMS Contest

Duration

The Teka-Teki Interactive Word Game (“the Contest”) begins from 16 July 2007 – 16 May 2008 (“the Contest Period”).

The Contest is based on the show Teka-Teki (“the Show”) which is scheduled to be broadcasted over Sistem Televisyen Malaysia Berhad (TV3) during the Contest Period.

The broadcast time of the Show is as follow: Every Monday to Wednesday from 5:35pm-6:00pm. (hereinafter collectively referred to as Scheduled Broadcasting Time)

The Contest time during the Contest Period shall be during the Schedule Broadcasting Time or such other time that Sistem Televisyen Malaysia Berhad (TV3) shall decide from time to time.

Eligibility

The Contest is open to all Malaysian citizens and who are also subscribers of pre-paid and post-paid services of Maxis, DiGi and Celcom providing Short Messaging System (“SMS”) services and Telekom Malaysia fixed line users. (the “Contestants”)

Employees of Sistem Televisyen Malaysia Berhad (TV3) and Juita Viden Sdn Bhd (JV) (permanent or temporary), its affiliates, advertising and promotion agencies and all participating Network Operators and their immediate family members are not eligible to participate in this Contest.

The Contestants must be the age of eighteen (18) years with a valid National Registration Identification Card (“NRIC”) number at the time of participation of the Contest.

Contestants under age of eighteen (18) must seek parental and/or guardian approval to participate, as well as valid consent to use the bill payer’s NRIC number and mobile phone/fixed line to enter the Contest.

The Contestants shall be permitted to participate in the Contest via the use of their mobile phone and Telekom Malaysia fixed line only.

TV3 and JV shall hold the bill payers responsible for any action that arises from the use of their NRIC numbers or mobile phone/fixed line for the Contest and shall not be responsible for any misuse of the bill payer’s NRIC number or mobile phones for the Contest by any Contestant.

By allowing their mobile phones to be used – bill payers acknowledge that they are bound by these Terms and Conditions. Payment shall be made irrespective of whether such charges were authorized by the bill payer.

For the purposes herein, the term “bill payer” shall mean the individual company or entity specified in the registration or subscription form whose application for the relevant service has been approved and accepted by the service provider.

Contest Mechanics

To enter the Contest, the Contestant must tune in during the Schedule Broadcasting Time of the Show and the Contestant will then need to:

SMS: Type TK and send it to 39868.

Fixed line: Call 13773. Available only to Telekom fixed line user.

All the Contestants will be charged a premium of:

SMS: RM 3.00 on top of the normal SMS charges.

Fixed line : RM 3.00 per successful call.

The Eligible* Contestant will be call back by the host/producer of the Show on the mobile number/fixed line number used to take part. The Contestant will be asked to answer the word game on-air (question on broadcast) as shown during the Show.

The term “Eligible” for the purpose of this Contest shall mean the Contestant who be able to answer the question correctly in the shortest time (from either the SMS and fixed line) to participate in this Contest. Should there be an event of a tie; the earliest entry for the particular episode will emerge as the eligible Contestant. This will be announced by the host during the show.

Mechanics for SMS Contestant:

Type in TK then send to 39868
The Contest engine will then send one question to the Contestant.
Contestant response by keying TKANSWER and send to 39868.

Mechanics for Fixed Line Contestant:

Call will automatically get connected to a pre-recorded voice message where the system will automatically ask the Contestant one question.

Caller response by keying the correct answer as at #1 for answer (A), #2 for answer (B) and #3 for answer (C)

The moment when all is connected to the pre-recorded voice message, the caller will be charged RM 3.00 regardless of whether the caller listen to the pre-recorded voice message for less than 1 second or for the entire duration of the pre-recorded voice message.

The host/producer will call the first Eligible Contestant and will require the Contestant to answer the word game on-air (question on broadcast). Where the host/producer is unable to contact the Contestant after three (3) attempts, the host/producer reserves the sole and absolute discretion to contact the next Eligible Contestant (which is the second fastest caller and so on) to answer the word game on-air (question on broadcast).

If the Eligible Contestant answers the word game on-air (question on broadcast) wrongly, then the host/producer of the show will call the next Eligible Contestant on the mobile number/fixed line number used to take part.

Once the Contestant answers the word game on-air (question on broadcast) wrongly, to participate again, the Contestant needs to SMS/call again. If the Contestant answers the word game on –air (question on broadcast) correctly, then the Contestant will win the prize(s) offered as mentioned by the host in each word game of the episode.

Contest Entries

The Contestant must ensure that their Contest entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified.

All Contest entries must be submitted in Bahasa Melayu. Contest entries in any other languages will be rejected.

Proof of SMS sent by a Contestant does not denote proof that the SMS system provider received the SMS.

TV3 and JV reserve the right to reject any registration and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever.

Contestants can send in as many Contest entries as they wish.

During the Contest Period, Contestants will be prompted to participate in the Contest via the on-air promos, Sistem Televisyen Malaysia Berhad (TV3) website www.tv3.com.my, customer care line 03- 7804 1992 (Office hour: 9:00am – 6:00pm) or any other communication medium to be determined from time to time as and when needed.

Selection of Winners

Contest winners will be chosen based on the correct answer given on word game on-air (question on broadcast) as shown during the Show on-air.

Judging

The Judge’s decision is final and binding. No correspondence shall be entertained.

Notification of Contest Winners

Contest winners will be notified by and telephone call to his/ her mobile phone for which the contact number shall be the number used by the Contestant for submission of the answers. TV3 and JV reserves the right to use any other method or medium deems fit at its sole and absolute discretion for the purpose of announcing the Contest winners.

Upon request, Contest winners will be required to give their contact details, NRIC number and any other details deemed necessary and relevant by the TV3 and JV.

TV3 and JV reserve the right to forfeit prizes for any Contest winner who does not provide the required details upon receiving the request/notification.

TV3 and JV reserves the right to appoint a third party to conduct the verification of Contest winners and to fulfill the delivery of prizes and Contestants agree that the TV3 and JV may provide all necessary information of Contest winners to such third party to facilitate such verification.

Contest Prizes

Prizes for the winner:

First Word Game - Cash Prize

24 Hours (Over Night) Word Game - Cash Prize

The winner will win the amount that announced by the host in each segment of the episode.

The Contest winner shall be responsible for all costs in connections with perfecting his/her prize. Cash prizes shall be issued to the winners in the form of a cheque in 60 days after the aired date of the show. Winners will be responsible for all related banking charges (including outstation cheque charges) imposed by banks in clearing his/her cheque.

Prizes not won or unclaimed within 60 days upon request/notification shall be forfeited.

Contest winners are solely responsible for the collection of their prize(s) which must be claimed in person unless TV3 and JV advise otherwise. Photograph Identification must be produced (e.g. NRIC/driver’s license/passport which displays a photograph of the Contest winner).

In special situations and subject to the absolute discretion of TV3 and JV a Contest winner may nominate a designated representative to collect a prize. The representative must present written authorization from the Contest winner and photograph identification for both the Contest winner and their representative.

In the event that a Contest winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of TV3 and JV.

Prize Giving Ceremony

In the event TV3 or JV has a prize giving ceremony, the Contest winners are required to attend at their own cost and expense to collect the prize. In the event the Contest winner is not able to attend the prize giving ceremony, the Contest winner must nominate a representative to be present at the prize giving ceremony to accept the prize on his/her behalf.

Publicity

TV3 and JV reserves the right, at its sole and absolute discretion, to use the nicknames, names, photographs, voice or video recordings and entries of the Contest winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media.

Adherence to Contest Terms & Conditions

In addition to these Terms and Conditions, instructions and methods of participating in the Contest, as set out on TV3 Website otherwise, shall also bind all Contestants and their participation in the Contest.

In the event of any conflict between these Terms and Conditions and any terms contained in any promotional material for this Contest, the terms contained herein shall apply.

Failure to comply with the rules, regulations, instructions or methods will result in the Contestants being disqualified.

By participating in this Contest, the Contestant is taken to have read and agreed to the terms and conditions herein and shall adhere to all and/or any decisions made by the TV3 and JV.

Variation to the Terms & Conditions

TV3 and JV reserves the right to change, amends, deletes or adds to these Terms and Conditions without prior notice at any time and the Contestants shall be bound to such changes.

Liability
TV3 and JV will not be responsible or liable for:

any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a SMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating mobile phone operators and/or by the TV3 and JV and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, TV3 and JV shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time.

any problem, damage or loss of whatsoever nature to any Contestant, or their authorized representatives resulting from their participation in the Contest.

any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

The Contest is provided on an “as is where is and where available” basis. TV3 and JV will not be responsible and will not be liable if any entry is lost, late or undelivered due to any reason other than the sole negligence of TV3 and JV.

These Terms and Conditions shall be governed by Malaysian law and any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the Malaysian Courts. TV3 and JV/ Contest judges have the right to amend the Terms and Conditions at any point.

TV3 and JV, their partners and their sponsors shall not be held responsible for any late, lost, incomplete or misdirected entries, computer system, phone line, electronic equipment, computer hardware, software and program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature or for problems in downloading SMS entries or for any other technical problems related to SMS entries.

TV3 and JV, and their sponsors are not responsible for any incorrect or inaccurate entry information, whether caused by its subscribers or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries in the Contest.

Disqualification

TV3 and JV reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Terms and Conditions and/or the TV3’s Website Terms of Use and Notices. No correspondence shall be entertained.

Suspension

TV3 and JV further reserve the right to cancel, modify, suspend or delay the Contest in the event of unforeseen circumstances beyond its reasonable control.
